In a world grappling with economic inflation, litigation funding, nuclear verdicts, and growing anti-corporate sentiment, understanding social inflation has never been more crucial. This comprehensive white paper is a valuable resource for those seeking to understand and mitigate the effects of social inflation in today's economic climate.

Tort Reform News

In response to the continued trend of nuclear verdicts, inflated settlements and legal system abuse, several states are currently considering various tort reform measures to improve their respective legal environments.

Tort reform, or lawsuit reform, refocuses litigation on the reasonable reimbursement of injured victims for wrongs committed against them by another’s actions.  States with fair and predictable legal systems deter undesirable behavior and don’t over-punish.

Some priority issues needing reform are disclosure of third-party litigation funding, efforts to curb jury anchoring, eliminating “phantom damages”, attorney advertising reform, and defending against liability expansions.

Georgia Tort Reform Efforts

Georgia just enacted major reforms to its tort claims system in an effort to reduce outsize jury awards, reduce costs, and create a more balanced legal environment.

Key provisions of Georgia’s legislation include:

  • Limit Anchoring: Prohibits plaintiffs’ attorneys from “anchoring” juries before the close of evidence by telling the jury exactly how much money they think someone should get for pain and suffering. This empowers juries to make fair decisions based on the facts of the case without being swayed by irrelevant arguments. 
  • Phantom Damages: Plaintiffs can only claim the actual amount paid for medical expenses, not the billed amount, preventing the introduction of inflated costs or “phantom damages.” Special damages are limited to the reasonable value of necessary medical costs.
  • Bifurcation: Allows attorneys to elect to “bifurcate” trials so that juries evaluate fault first and then damages if fault is found. The separation of liability and damages phases helps to prevent juries from being influenced by the extent of injury or damages when deciding liability. It reduces the opportunity for sympathy to creep into the liability decision.
  • Seat Belt Evidence: Defendants will now be able to present evidence if a plaintiff wasn’t wearing a seatbelt in an auto accident. This can help mitigate damages in cases where the plaintiff’s injuries were worsened by not using this essential safety feature.
  • Third-Party Litigation Funding: Required disclosure of litigation funding to increase transparency.  All parties, including courts and opposing litigants, will have visibility into third-party funding arrangements, ensuring fairness and accountability.

Carriers and policyholders alike are hopeful these types of measures will restore a fair, balanced and predictable legal system.
