This Privacy Policy describes how Associated Electric & Gas Insurance Services Limited and its affiliates (collectively, “AEGIS” or “we” or “us” or “our”) collect, use, and disclose Personal Information. That includes Personal Information we collect through or in connection with your access and use of our website (aegislink.com), communications with us electronically such as via email, and when you interact with us offline, including in person, or by phone (our “Services”). Your privacy is important to us.  We are dedicated to protecting privacy and Personal Information.  Please carefully review this Privacy Policy before providing Personal Information to us.

Personal Information,” for purposes of this policy, is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly with, you or your household. Personal Information does not include publicly available information or information that is deidentified or anonymized consistent with applicable privacy laws.

Note that the “category” of data listed below refers to the category of Personal Information as defined under California law and represents the categories of Personal Information that we have collected, and how it has been shared, over the past 12 months. Inclusion of a category in the list below indicates only that we may collect some information within that category.[1]

We have disclosed Personal Information in each of the categories listed below to our affiliates, Third-Parties, and other service providers, as well as to government entities where required, for our business purposes within the past 12 months. Please note that we have not necessarily disclosed every type of information listed in a given category.

5. How We Share Your Personal Information

  • We may share Personal Information with companies and individuals that we contract with in order to receive services (our “Service Providers”).  These services may include, among other things, providing services or products to you on our behalf, creating or maintaining our databases, enabling website functionality and, with your consent, providing analytics on how you engage with our website, or preparing communications to you on our behalf.  We endeavor to require our Service Providers not to use or disclose Personal Information for any purpose other than for providing services to us;

  • We will share Personal Information with the corporate entity that has contracted with us to maintain its insurance policy in order to process any claims made against you or on your behalf;
  • We may share Personal Information with other entities involved in the processing of your claim, such as your agents and brokers, investigators, adjusters, attorneys and others who may become involved in processing your application, servicing your policy or claims, and with persons or organizations performing insurance functions for us;
  • From time to time, we may be required to provide Personal Information to a Third-Party in response to a court order, subpoena, government investigation, or as otherwise required by law or legal process;
  • We may share Personal Information with Third-Parties, such as law enforcement agencies or governmental authorities (i) when we, in good faith, believe you or others are acting unlawfully; (ii) when we believe it is necessary or appropriate to satisfy any law, regulation, or other governmental request; (iii) to operate our business and websites properly; (iv) to protect or defend our rights or the rights or well-being of our users, even without a subpoena, warrant or court order; or (v) when we believe disclosure is necessary to protect the health and safety of our personnel, customers, clients, members, guests, or the general public.  This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction; and
  • We may, as a result of a sale, merger, consolidation, change in control, transfer of assets, reorganization or liquidation of our company (a “Reorganization Event”), transfer or assign Personal Information to parties involved in the Reorganization Event.

7. Additional Notice to and Rights of California Residents

If you are a California resident, you may have certain rights under the California Consumer Privacy Act (“CCPA”) and California’s “Shine the Light” law.  We do not share Personal Information with Third-Parties for their direct marketing purposes.

Depending on the type of data collected, you may have rights with respect to your Personal Information, subject to certain exemptions provided by law. Because we often process Personal Information for corporate entities, we may forward your privacy request to your corporate employer in order to process the request.

You may do the following with respect to your Personal Information:

  • Ask what Personal Information we have.  You may request to know (i) the specific pieces of Personal Information we have about you; (ii) the categories of Personal Information we have collected about you in the last 12 months; (iii) the categories of sources from which that Personal Information was collected; (iv) the categories of your Personal Information that we disclosed in the last 12 months; (v) the categories of Third- Parties to whom your Personal Information was disclosed in the last 12 months; and (vi) the purpose for collecting disclosing your Personal Information.
  • Request deletion of your Personal Information.  You may request that we delete the Personal Information that we have collected or maintain about you.  We may deny your request under certain circumstances, such as if we need to comply with our legal obligations or complete a transaction for which your Personal Information was collected.  If we deny your request for deletion, we will let you know the reason why.
  • Request correction of your Personal Information.  You may request correction of any inaccurate information we hold about you.  We may deny your request under certain circumstances, such as if we need to comply with our legal obligations.  Information solely retained for data backup purposes is generally excluded.  If we deny your request for correction, we will let you know the reason why.
  • The right to equal service.  If you choose to exercise any of your rights, we will not discriminate against you in any way.  If you exercise certain rights, understand that you may be unable to use or access certain features of our Services.

You may exercise your right to know and your right to deletion twice a year free of charge.  To exercise your right to know or your right to deletion, please contact us at 1.866.692.3447 or CCPA@aegislimited.com.  We will respond within 45 days of receiving your request. Where reasonably necessary, we may extend this period by an additional 45 days, and we will notify you if an extension is required.

We will take steps to verify your identity before processing your request to know or request to delete.  We will not fulfill your request unless you have provided sufficient information for us to verify you are the individual about whom we collected Personal Information.  If you have an account with us, we may use our existing account authentication practices to verify your identity.  If you do not have an account with us, we may request additional information about you to verify your identity (such as your contact information and/or insurance information).  We will only use the Personal Information provided in the verification process to verify your identity or authority to make a request and to track and document request responses, unless you initially provided the information for another purpose.

You may use an authorized agent to submit a request to know or a request to delete.  When we verify your agent’s request, we may verify both your and your agent’s identity and request a signed document from you that authorizes your agent to make the request on your behalf.  To protect your Personal Information, we reserve the right to deny a request from an agent who does not submit proof that you have authorized the agent to act on your behalf. 

8. Third-Party Content and Links

We provide links to other websites that contain information that we believe you will find valuable.  However, we do not control or operate such Third-Party websites and cannot control how these Third-Party websites handle your Personal Information.  

9. Data Storage; Security; Retention

The data that we collect from you may be transferred to, stored at, or processed by our staff at any destination worldwide.  Please be aware that the data protection and consumer protection laws of the locations in which we process your Personal Information may differ from the laws in your country. 

The Personal Information you submit to us will be processed in the jurisdictions in which we operate and may be subject to access by law enforcement and other government entities, including courts and tribunals, in accordance with laws applicable in those jurisdictions.

We take reasonable steps to ensure that your data is treated securely.  However, the transmission of information via the internet is not completely secure and we cannot guarantee the security of your data transmitted to us electronically.  Any such transmission is at your own risk.

We retain your information for as long as necessary for the purposes for which your Personal Information was collected and as required by law. For the avoidance of doubt, Personal Information will not be destroyed before any regulatory retention period expires, or during a pending investigation, whether legal or regulatory.

To support us in managing how long we hold Personal Information and our record management, we maintain guidelines on retention and deletion.

We consider the following criteria when determining how long a particular record will be retained, including any Personal Information contained in that record:

  • How long the record is needed to provide you with the products and services you request
  • How long the record is needed to support and enhance our operational processes
  • How long the record is needed to protect our rights and legal interests
  • How long the record must be retained to comply with applicable laws and regulations

The same Personal Information about you may be included in more than one record and used for more than one purpose, each of which may be subject to different retention periods based on the factors listed above.

10. Minors and Children

Our Services are intended for general adult audiences and are not intended for anyone under 18 years of age. We do not knowingly collect, store, use, sell, or share the Personal Information of children who are under 18 years of age.
