Random Drug and Alcohol Testing – OSHA Trumps ADA

March, 2013 - Employee impairment due to drug and alcohol usage is one of the leading causes of workplace accidents. The enclosed article about a recent Federal court decision affirming an employer’s right to conduct random drug and alcohol testing for safety purposes is supportive of such programs. The court ruled in favor of the employer and against the EEOC which contended that such testing violated the ADA.
