Electric Claims/Litigation Symposium
The Electric Claims/Litigation Symposium provides attendees with an array of experienced speakers discussing the various stages of claims management from the initial response through the resolution of the claim in order to reduce loss exposure and manage litigation costs.

This one-day symposium will address:

  • How to manage public relations surrounding the incident
  • Key investigation criteria
  • How to work with primary and excess carriers
  • Long and short term defense strategies

8:45 AM to 9:00 AM Welcome/Opening Remarks
A brief overview of AEGIS Electric Litigation Services (AELS) which has been developed to better serve AEGIS members presently involved in, or imminently threatened by, electric-related litigation.
 
9:00 AM to 9:45 AM The Response Team - Notification and Communication
A discussion of the initial steps taken upon notification of an incident; assembling an appropriate team to respond to the incident; coordination of the early involvement of counsel as it concerns the attorney/client privilege, the investigation and retention of appropriate experts.
 
9:45 AM to 10:30 AM Public Relations
A discussion of the issues that arise in addressing the public and media when an incident occurs, including the role of media coordinator and the relationship between the coordinator and public officials.
 
10:30 AM to 10:45 AM Morning Break
 
10:45 AM to 12:15 PM Investigation - Protection of Work Product, Use of Experts, Records Searches
A thorough initial investigation is essential in determining potential liability and exposure. A review of the use of in-house professionals; the need for early involvement of experts; procedures for record searches; the preservation of evidence; and the need to establish a valuable relationship between the member and public officials, such as fire, police, the PSC, OSHA, etc.

1:15 PM to 2:00 PM The Role of Insurance Carriers
All carriers should be notified of their potential involvement in a major incident. An analysis of reporting requirements and procedures for the primary and excess carriers; as well as the benefits of early notification, e.g. AELS, experts, counsel.
  
2:00 PM to 2:45 PM Long & Short Term Strategies
Topics to be included are contract review; indemnification and hold harmless agreements; applicable laws, statutes, tariffs, etc.
 
2:45 PM to 3:00 PM Afternoon Break
 
3:00 PM to 3:45 PM Litigation Management Plan
A discussion of effective claims management procedures, including the role of counsel and the implementation of a litigation management plan. The appropriate use of ADR, e.g., mediation, arbitration, etc., will be addressed, along with the value of structured settlements in negotiations.
 
3:45 PM to 4:15 PM Questions and Closing Remarks
